Legal reasoning means one always needs to choose the decision required by rules and precedents rather than the decision all-things-considered. The force of law lies in the divergence between sound decisions and legally binding decisions. Therefore, the Rule of Law might not be optimal and need to be repealed in some cases.
Deference, legal presumptions, burden of proof, burden of persuasion, burden of production of evidence. At the heart of much of law's use of its characteristic reasoning devices is its acceptance of the fact that the best decision is not always the best legal decision.

When I can illustrate an issue in English in such a subtle but precise way as Schauer did, I will give myself a holiday to celebrate.
