哈佛大法学院的路易斯・杰夫( Louis L。Jaf)教在一篇论著中这样写道: 对于联邦最高法院的判决,会有也应该有来自民众的反应这种反应不是法律教授所发表的那种“世事洞明’( informed)的批评,而是外行发自内心的、充满感情的、直接素的反应。之所以会这样,正是因为美国联邦最高法院是现代世界所有法院中承担更多制定政策任务的司法机构,同时,它又很少受制于正式的民主控制,…… 从政治的角度来说,在一个民主国家中,最高法院必须准备接受激愤民众的指责。" 杰夫教授的这段话提醒了我们一个很容易被人遗忘的事实:联邦最高法院必须经常向世人证明其有能力作为联邦政府三个重要的权力中心之一。 (
